1. Privacy Policy
Data Controller. The data controller responsible for the processing of personal data collected through this website is AxionBridgeLabs, registered at Calle Marqués de Larios, 14, Piso 4º Centro — 29005, Málaga, Málaga, España. Data We Collect. When you submit a contact form or otherwise communicate with us, we may collect the following personal data: your full name, email address, telephone number, and any information contained in your message. We do not collect special category data (such as health, racial, or political information) through this website.
Purpose and Legal Basis. Your personal data is processed on the basis of your consent (Article 6(1)(a) GDPR) and for the legitimate interest of responding to your inquiry and managing our business relationship (Article 6(1)(f) GDPR). We use your data solely to: (a) respond to your inquiries and provide requested services; (b) manage ongoing professional relationships; (c) comply with legal obligations under Spanish and EU law.
Data Retention. Personal data submitted through contact forms is retained for a maximum of 24 months from the date of last communication, unless a longer retention period is required by law or necessary for the resolution of an active legal dispute. After this period, data is securely deleted from our systems.
Data Sharing. We do not sell, rent, or trade your personal data. Data may be shared with: (a) hosting providers and email service providers who process data on our behalf under written data processing agreements (Article 28 GDPR); (b) legal or tax advisors when required by law; (c) public authorities when legally obligated.
International Transfers. Some of our service providers may process data outside the European Economic Area. In such cases, we ensure appropriate safeguards are in place, including Standard Contractual Clauses (SCCs) approved by the European Commission, to protect your personal data in accordance with Chapter V of the GDPR.
Your Rights. Under the GDPR, you have the right to: (a) access your personal data (Article 15); (b) rectify inaccurate data (Article 16); (c) request erasure of your data ("right to be forgotten") (Article 17); (d) restrict processing (Article 18); (e) data portability (Article 20); (f) object to processing (Article 21); (g) withdraw consent at any time without affecting the lawfulness of processing prior to withdrawal (Article 7(3)). Supervisory Authority. If you believe your data protection rights have been infringed, you have the right to lodge a complaint with the Spanish Data Protection Authority (Agencia Española de Protección de Datos — AEPD) at www.aepd.es.
Children's Privacy. This website is not directed at individuals under the age of 16. We do not knowingly collect personal data from children. If we become aware that a child has provided us with personal data, we will take steps to delete such information promptly.
Changes to This Policy. We reserve the right to update this Privacy Policy at any time. Any changes will be posted on this page with an updated revision date. Continued use of the website after changes constitutes acceptance of the revised policy.
3. Refund Policy
Applicability. This Refund Policy applies to all services provided by AxionBridgeLabs, located at Calle Marqués de Larios, 14, Piso 4º Centro — 29005, Málaga, Málaga, España. By engaging our services, you acknowledge and agree to the terms set forth in this policy.
Milestone-Based Payment Structure. Projects are invoiced according to agreed-upon milestones defined in the project proposal or statement of work. Payment for completed milestones is non-refundable once the corresponding deliverable has been provided and accepted by the client, whether explicitly or through use.
Cancellation Before Work Begins. If you wish to cancel a project before work has commenced on the current milestone, you may request a full refund of any advance payment for that milestone. Requests must be submitted in writing to [email protected].
Cancellation During Active Work. If a project is cancelled while work is in progress on a milestone, AxionBridgeLabs is entitled to retain payment proportional to the work completed up to the point of cancellation. A detailed breakdown of completed work will be provided upon request.
Deliverable Disputes. If you are dissatisfied with a delivered milestone, you must notify us in writing within 14 calendar days of delivery, detailing the specific deficiencies. We will make reasonable efforts to rectify the issues within 10 business days. If the deficiencies cannot be resolved to your satisfaction, a partial refund may be negotiated in good faith based on the extent of unresolved issues.
Non-Refundable Items. The following are non-refundable: (a) completed and accepted milestone deliverables; (b) third-party costs incurred on your behalf (such as hosting fees, domain registrations, or software licenses); (c) consulting or advisory hours that have been delivered.
Refund Processing. Approved refunds will be processed within 14 business days via the original payment method. Bank transfer refunds may take additional processing time depending on your financial institution.
Dispute Resolution. In the event of a dispute regarding refunds, both parties agree to attempt resolution through good-faith negotiation before pursuing any legal remedies. This policy is governed by the laws of Spain and the European Union.
4. Terms of Service
Acceptance of Terms. By accessing or using the website and services provided by AxionBridgeLabs, located at Calle Marqués de Larios, 14, Piso 4º Centro — 29005, Málaga, Málaga, España, you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use our website or services.
Scope of Services. AxionBridgeLabs provides technical web application development, hosting environment optimization, automation script engineering, and related digital services as described on this website and in individual project proposals. The specific scope, deliverables, timeline, and pricing for each engagement are defined in a written project proposal or statement of work agreed upon by both parties.
Intellectual Property. Upon full payment of all invoiced amounts, the client receives full ownership of all custom code, designs, and deliverables produced specifically for the project as defined in the statement of work. AxionBridgeLabs retains the right to use general knowledge, techniques, and non-proprietary methodologies developed during the course of engagement. Pre-existing tools, libraries, and frameworks used in the project remain the property of their respective owners.
Confidentiality. Both parties agree to maintain the confidentiality of proprietary information shared during the course of an engagement. This includes business strategies, technical specifications, source code, and any information marked as confidential. This obligation survives the termination of the engagement for a period of 24 months.
Payment Terms. Invoices are due within 14 calendar days of issuance unless otherwise specified in the project proposal. Late payments may incur a surcharge of 1.5% per month on the outstanding balance. AxionBridgeLabs reserves the right to suspend work on any project where payments are overdue by more than 14 days.
Project Timelines. Project timelines provided in proposals are estimates based on current workload and project complexity. Delays caused by the client (including late feedback, delayed approvals, or late provision of required materials) may extend the timeline accordingly. AxionBridgeLabs will communicate any anticipated delays promptly.
Limitation of Liability. AxionBridgeLabs shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services. Our total liability for any claim related to a project shall not exceed the total fees paid for that specific project. We are not responsible for losses resulting from third-party service outages, force majeure events, or client misuse of delivered products.
Warranty. AxionBridgeLabs warrants that all deliverables will be free from material defects and will conform to the specifications defined in the project proposal for a period of 30 days following delivery. This warranty does not cover issues arising from client modifications, third-party integrations, or environmental changes beyond our control.
Termination. Either party may terminate a project engagement with 14 days' written notice. Upon termination, the client is responsible for payment of all work completed up to the date of termination. All completed deliverables and source code for paid milestones will be transferred to the client within 7 business days of final payment.
Governing Law. These Terms of Service are governed by and construed in accordance with the laws of Spain and the European Union. Any disputes arising from these terms or from the use of our services shall be subject to the exclusive jurisdiction of the courts of Málaga, Spain.
Modifications. AxionBridgeLabs reserves the right to modify these Terms of Service at any time. Changes will be effective upon posting to this website. Continued use of the website or services after changes constitutes acceptance of the modified terms.
